AB1138 Frommer !SIGNED! Parking Placard Certification Requirements

This bill, on and after July 1, 2005, would require a disabledperson or disabled veteran issued a special license plate, uponrequest, to present to a peace officer, or person authorized toenforce parking laws, ordinances, or regulations, a certificationform, as prescribed by the department, that substantiates theeligibility of the disabled person or veteran to possess the plate. Because a violation of these provisions would be a crime, thisbill would impose a state-mandated local program.

This bill places the burden of the abuse on the heads of placard and plate holders. It places the legitimate holders of the placards and plates in a position of being harrassed and confiscation of the plates or placards if the paper certification is not on the person! This bill will cost the State millions of Medicaid Dollars as every plate holder must get a new certificate signed by a doctor. Current law does not "require" a doctors signature when the disability is visable.

Glad you figured this BLOG out! What is different? The NEW DMV form WILL require a DOCTORS signature. The DMV web page rightly says that 'When disabling condition is visable, no Dr's signature is required", and the DMV certs the Placard or License. Also this bill requires that PLATE holders get this NEW certificate. It will not be mailed to you, there will be "outreach" and letters to Doctors offices....so the first time you don't have the NEW Certificate, they CAN CONFISCATE your plate or placard as not having the CERTIFICATE is presumptive under this bill that you are not entitled. Do you still have the paperwork from your license?
Why aren't they mailing a cert to all plate holders? Because they wanted to say this bill will only cost $25K to DMV. Of course they did not include the cost to the state medi-Cal for all those 250,000 plate holders and 2 million placard holders going in for a signature. This law has NO provision for a spouse driving the modified vehicle, they do not cite for PARKING inappropriately, they cite for NO CERT!
This is a bad bill that will cause many headaches to our community and harrassment of legitimate plate and placard holders.

The only way to get rid of the tens of thousands of people with parking permits who should not have them is to require this new certification. A doctor's signature should be required. People have rented a wheelchair for the day so as to look disabled and get a placard without needing a doctor's signature. This abuse has to stop. Instead of a "certificate" the driver's license number of the placard holder should be on the placard - if the person does not drive then use the number off of a state issued photo I.D. The placard should only be valid for use when the person whose driver's license number or I.D. on the placard is with the vehicle. If the person who owns the placard is not there or does not have the related photo I.D. the placard or license plate should be seized.
